Terms and Conditions

BOOKING FEE/DEPOSIT

A 20% non-refundable deposit is required upon booking in order to secure the date. The remaining fees are due 14 days before the date of the wedding/shoot. Deposits will not be refundable under any circumstances.

PRODUCTS AND DELIVERY

- PHOTOS TURNAROUND TIME: The turnaround time is NOT a guarantee. Turnaround time is a reasonable estimate considering schedules and the length of the projects. Please keep in mind that delays may also be the result of slow communication with us, client requests and sometimes technical difficulties. 

Estimated turnaround time for the photos is within 6 - 8 weeks from the date of the wedding. However, in the unlikely event of any unforeseen circumstances preventing the delivery within this timeframe or delaying the timeframe, you will be contacted and kept updated on its progress. ANY SHOOTS THAT ARE DIFFERENT TO A WEDDING WILL BE INFORMED ON DAY OF SHOOT OR WHEN BOOKING OF DELIVERY EXPECTATIONS, if you need to know this information before booking, then please ask us before making your payment.

- Retouch editing of photos is not offered. Retouch editing includes things like adding or removing objects or specific skin details or blemishes etc.

- Emma Dyce Photography ensures that all gear is maintained and well kept: this means technical difficulties are uncommon, however will not be held responsible for any loss due to technical fault or corruption of video/photo footage or files on the day. In the event that this happens, a refund will be given to the proportion of footage/files lost.

COPYRIGHT LAW

- All photos, footage and final works and edits, will remain the property of Emma Dyce Photography and are for client’s personal viewing and use ONLY. Written consent is required for any commercial or other non-personal uses of works created by Emma Dyce Photography. Furthermore, we do not allow re-edits or any extra touch ups done by anyone other than Emma Dyce Photography. Emma Dyce Photography grant the client USE RIGHTS of any images/video provided. These rights for use are for life & any non-personal distribution, re-touching or re-editing would be breaching copyright. 

- USE RIGHTS grant the client permission to use the photos/video/footage in a personal manner, however, they do not permit a client to alter or change these files in any way. This includes putting filters over photos or using raw footage to create a new video. The client may print and make copies or the photos for personal use including giving them to family/friends as gifts, however the same copyright rules apply. 

- Any distribution of images, footage or video to other vendors (florists, caterers, venues etc) will be done by Emma Dyce Photography. In the spirit of cooperation, the client agrees to provide a list of any vendors and their email address. Emma Dyce Photography kindly ask that the client lets vendors know of this so that they know to come to Emma Dyce Photography for copies of photos and video. 

DIGITAL STORAGE

Emma Dyce Photography will not be able to keep a copy of the video/photo files forever. This can be due to hard drive storage management and in much worse scenarios loss, damage or theft of hard drives. It is the client’s responsibility to make several copies of the digital videos/photos and store them in more than one separate location, saving the files onto formats such as a computer, external hard drive, USB and/or cloud storage.

CANCELLATION/ POSTPONEMENT

All payments and agreed revenue payments are final and non-refundable. In the event that you wish to cancel your booking, your deposit is non-refundable, and there will be no refund offered. If for some reason you need to swap or postpone the shoot date, then the booking will be swapped to the new date ONLY if approved by Emma Dyce Photography. Any new costs that arise from this kind of change (i.e. travel costs, hire costs) will be at the expense agreed upon by Emma Dyce Photography and the client.
